Two Chubb insurance units have dropped their lawsuit alleging that the city of New Britain, Connecticut, owes them more than $1.8 million in coverage reimbursements because it was slow to respond to a water main break that caused severe flood damage.
On Monday, Chubb Indemnity Insurance Co. and Great Northern Insurance Co. LLC withdrew their suit from the District of Connecticut with prejudice under Federal Rule of Civil Procedure 41(a)(1)(A)(i), which allows for voluntary dismissal before a defendant responds to a complaint. The companies' notice did not explain the decision.
The negligence suit filed July 9 alleged that when a water main broke on Childs Street on July 15, 2023, the water department took more than two hours to respond. In the meantime, the plaintiffs' policyholders, Marsam Metal Finishing Co. and J.F. Fredericks Aero LLC, suffered damage from continuous water flow, the complaint said.
Chubb Indemnity paid more than $1 million to Marsam and Great Northern paid more than $800,000 to J.F., according to the complaint, which said that the adjustments were ongoing and more payments might become necessary.
Counsel for the parties did not immediately respond to requests for comment.
The Chubb units are represented by Jonathan M. Ciriello of Cozen O'Connor PC.
New Britain is represented by Abigail R. Willauer and Thomas R. Gerarde of Howd & Ludorf LLC.
The case is Chubb Indemnity Insurance Co. et al. v. City of New Britain, case number 3:25-cv-01090, in the U.S. District Court for the District of Connecticut.
